Understanding Court Fees in Pakistan
Court fees in Pakistan are payable when filing a plaint, petition, or appeal in any civil or family court. The fee is typically calculated as a percentage of the claim amount or subject matter value, subject to minimum and maximum limits set by provincial rules.
Types of Court Fees
Ad valorem fee: A percentage of the claim amount — applies to civil money suits, recovery suits, and property disputes
Fixed fee: A flat amount for specific case types like custody, injunction, and declaration suits
Process fee: A separate fee for issuing summons, notices, and commissions
Court Fee by Province
Each province has its own Court Fees Act or rules governing the applicable rates. Islamabad follows the Court Fees Act, 1870 as applicable to ICT. Punjab, Sindh, KPK, and Balochistan each have their own amendments and schedules.
Family Court Fees
Family court cases (under the West Pakistan Family Courts Act, 1964) generally have nominal filing fees — typically PKR 1,000 to PKR 5,000 — regardless of the claim amount. This makes family court proceedings accessible to all.
